In partnership with the Florida Department of Environmental Protection (DEP), the state of Florida has been granted authority by the EPA to oversee its own National Pollutant Discharge Elimination System (NPDES) Permitting Program. This initiative addresses wastewater and stormwater discharges associated with various activities, such as construction, industrial operations, and Municipal Separate Storm Sewer System (MS4) activities. To adhere to EPA and The Clean Water Act regulations regarding stormwater pollution management, the DEP has established and manages the Florida Pollutant Discharge Elimination System (FPDES) Permitting Program. FPDES ensures compliance with all Clean Water Act and federal mandates, offering a framework for project owners and operators to secure permit coverage for discharging stormwater and wastewater into Florida’s surface waters.

TPDES Construction General Permit (CGP)

Under the FPDES Construction General Permit (CGP), authorization is provided for point source stormwater discharges arising from construction activities. This encompasses small and large-scale construction projects and ancillary construction support activities such as concrete batch plants and material storage yards. Owners or operators of project sites undertaking covered construction activities in Florida must seek FPDES Construction General Permit coverage before initiating any construction or land-disturbing activity. This entails electronically submitting a comprehensive Notice of Intent (NOI) through the Florida Department of Environmental Protection (DEP) website, along with a developed Storm Water Pollution Prevention Plan (SWP3). The SWP3 must delineate strategies to minimize pollutants in stormwater discharges associated with construction activity and non-stormwater discharges under the provisions outlined in the general permit.
